1. Introduction

Welcome to NV Fit (“we”, “our”, “us”), an Australian-based eCommerce store offering women’s activewear. By accessing our website or purchasing from us, you agree to be bound by these Terms and Conditions (“Terms”).

These Terms are governed by the laws of Australia and comply with the Australian Consumer Law (ACL). Nothing in these Terms excludes your rights under the ACL.

2. Products & Orders

We aim to ensure all product descriptions, images, and pricing are accurate. However, slight variations may occur.

We reserve the right to:

  • Refuse or cancel any order
  • Limit quantities purchased
  • Correct any pricing or product description errors

Order confirmation emails do not constitute final acceptance of your order.

3. Pricing & Payment

All prices are listed in Australian Dollars (AUD) and include GST (where applicable).

Payment must be made in full at checkout using the available payment methods.

4. Shipping & Delivery

We aim to dispatch orders promptly. Delivery timeframes are estimates only and may vary due to external factors.

We are not responsible for delays caused by shipping carriers.

5. Returns & Refunds Policy

At NV Fit, we want you to love your purchase. If something isn’t quite right, please review the following:

5.1 Size & Fit Returns

We understand that choosing the right size online can be tricky.

If your item does not fit, you may return it within 14 days of delivery, provided that:

  • The item is unworn, unwashed, and in original condition
  • All tags and hygiene liners remain attached
  • The item is free from marks, stains, deodorant, or perfume
  • Proof of purchase is provided

Eligible outcomes:

  • Exchange
  • Store credit

Please note:

  • We do not offer refunds for incorrect size selection or change of mind, as detailed sizing information is provided on each product page
  • Return postage costs for size exchanges are the responsibility of the customer

5.2 Sale & Clearance Items

Items marked as Sale, Clearance, or Final Sale are not eligible for return or exchange unless deemed faulty.

Please choose carefully when purchasing these items.

5.3 Faulty or Incorrect Items

If you receive a faulty item or an incorrect product, we sincerely apologise.

Please contact us within 7 days of receiving your order and provide:

  • Your order number
  • Clear photos of the fault or issue

We will assess the issue and provide a remedy in accordance with the Australian Consumer Law, which may include:

  • Replacement
  • Refund
  • Store credit

Return postage costs for faulty or incorrect items will be covered by NV Fit.

5.4 How to Lodge a Return

To initiate a return:

  • Email us at info@nvfit.com.au with your order number and reason for return
  • We will provide return instructions

Once received and inspected, your exchange, store credit, or refund (if applicable) will be processed within 5 business days.

5.5 Refund Processing

Approved refunds will be issued to your original payment method.

Please allow 3–10 business days for funds to appear in your account depending on your payment provider.

5.6 Important Conditions

  • We do not accept returns on worn, washed, or damaged items
  • Items returned without prior approval may not be accepted
  • We recommend using tracked postage for all returns
  • We are not responsible for lost return parcels

6. Consumer Guarantees

Under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage.

These rights cannot be excluded and apply in addition to our returns policy.

7. Intellectual Property

All content on the NV Fit website, including images, logos, designs, and text, is the property of NV Fit and may not be reproduced without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, NV Fit is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website.
